On February 7, 2020, Kaplan Fox filed a class action lawsuit against French cosmetics manufacturer L’Oréal in federal court in San Francisco, California. The lawsuit alleges that L’Oréal violated consumer protection and warranty laws when it marketed and sold a series of liquid cosmetic containers in defective pumps. The lawsuit alleges that L’Oréal is aware of the defects in the cosmetic pumps and that independent lab testing indicated that as much as 57% of the cosmetics remain stranded and inaccessible when the pumps fail. The consumers also state that the products cannot be opened safely because they are contained in sealed glass bottles, meaning they lose money on each purchase. The complaint seeks damages on behalf of consumers who bought any of the following products in California within the past four years:
• L’Oréal Age Perfect Eye Renewal
• L’Oréal Revitalift Bright Reveal Day Moisturizer
• Maybelline Superstay Better Skin-Transforming Foundation
• L’Oréal Visible Lift Serum Absolute
Kaplan Fox filed the case with the Snyder Law Firm LLC in Overland Park, Kansas and Williams Dirks Dameron LLC in Kansas City, Missouri.
