On March 6, 2020, a federal court in Phoenix, Arizona certified a class action against Walgreens, Elizabeth Holmes, and Ramesh “Sunny” Balwani in a series of lawsuits over patients’ claims that the defendants duped consumers into taking blood tests that were inaccurate and unreliable. The lawsuits were originally filed on behalf of patients who obtained Theranos blood testing services at Walgreens locations throughout Arizona and California in 2015 and 2016. The case generally alleges that Theranos misled consumers by advertising its proprietary “Edison” blood testing technology and other services were safe and effective for use for diagnosis and treatment even though the technology had not been reliably implemented or fully vetted by regulators. Investigative reporting has indicated that Theranos could not substantiate its claims regarding the efficacy of its testing protocols, resulting in shut downs of testing centers and voided lab results for over 400,000 patients. Now that the class is certified, the case will be set for trial. Plaintiffs in the case seek monetary damages and other relief.
