BodyArmor Sports Drink False Advertising Class Action
On January 28, 2020, Kaplan Fox filed a class action lawsuit against BA Nutrition in the United States District Court for the Northern District of California. On behalf of a nationwide class of consumers, plaintiffs allege that BA Nutrition violated California, New York, and various nationwide consumer protection laws by deceptively marketing BodyArmor sports drink as providing “superior hydration,” “more better natural,” and the like, when the hydration claims are not substantiated by science and, moreover, where routine consumption of BodyArmor links with type-1 diabetes and cardiovascular disease given its high sugar content. Plaintiffs also allege that BodyArmor is unlawfully fortified junk food.
