Kaplan Fox is court-appointed co-lead counsel for the plaintiffs in this digital privacy class action, challenging Yahoo’s practice of “scanning” incoming and outgoing emails for content, in order to more effectively target advertising. Judge Lucy Koh denied in part and granted in part a motion to dismiss the case, allowing plaintiffs to pursue a claim under California’s Invasion of Privacy Act.

Kaplan Fox filed a consumer fraud class action against Logitech alleging that its HD digital home security “Alert Systems” were defective and that Logitech breached California consumer protection and warranty laws. The lawsuit alleges, among other things, that Logitech marketed and sold Alert Systems that couldn’t provide continuous, reliable digital home security because the Alert Systems were defective and that the cameras experienced a high-rate of failure.

Kaplan Fox is co-counsel for the plaintiffs and proposed class of Horizon Blue Cross Blue Shield members whose personal identifying information and protected health information was stored on unencrypted laptops, which were later stolen in November, 2013. The information improperly stored on these portable devices relates to approximately one-third of all New Jersey residents.

Kaplan Fox seeks declaratory, injunctive and monetary relief related to Bayer’s practice of claiming “heart health,” “immunity support” and “energy” benefits related to its line of One A Day vitamin supplements. The amended class complaint alleges that these claims are unsupported by science and mislead consumers as to the actual benefits of these products.

Kaplan Fox is court-appointed co-lead counsel for the plaintiffs in this digital privacy class action, challenging Facebook’s former practice of secretly tracking the web browsing of its users, even after they logged out. The class action complaint alleged that the tracking constituted illegal wiretapping and violated other privacy laws, until researchers reported the practice and Facebook quickly stopped.
