On July 12, 2018, Kaplan Fox brought a proposed class action lawsuit against SkyWest Airlines in federal court in San Francisco, California. The lawsuit alleges that SkyWest failed to properly pay its “ramp agents” according to California wage and hour laws. The complaint identifies a number of potential violations including the failure to provide timely meal and rest breaks and the failure to pay all wages and overtime. The complaint alleges that the ramp agents, who assist with arriving and departing airplanes, are often called to duty when they are supposed to be receiving breaks and that they do not always get paid properly.
The case was filed as a proposed class action and also invokes the workers’ rights to obtain monetary penalties under California’s Private Attorney General Act, which deputizes private workers to enforce California Labor Code violations. The lawsuit seeks monetary damages, penalties and other relief to the impacted workers at airports throughout California.
