On June 21, 2016, Kaplan Fox filed a class action lawsuit against Theranos on behalf of those who paid for blood tests using its “Edison” technology. Plaintiffs’ Complaint alleges that Theranos blood tests were faulty and that consumers were misled that its supposed technology could provide accurate medical diagnoses and information when in fact they did not. Plaintiffs allege that Theranos engaged in poor quality control and other misconduct that led to incorrect test results and resulting problems with patients’ medical treatment. Theranos, a bio-tech start-up recently valued at $9 billion, has come under scrutiny by state and federal regulators over these issues, has stopped conducting blood tests and let go many of its employees. Plaintiff’s Complaint seeks damages from Theranos as a result of its violation of consumer protection laws.
