On March 26, 2016, Kaplan Fox filed a class action lawsuit against 21st Century Oncology on behalf of patients impacted by 21st Century Oncology’s medical data breach. Plaintiffs’ Complaint alleges that 21st Century Oncology, a nationwide network of cancer treatment centers, failed to protect its patients’ most sensitive medical and personal information, including their social security numbers. The data breach, announced on March 4, 2016, has potentially impacted 2.2 million patients. Plaintiffs’ Complaint alleges that 21st Century Oncology was not even aware that its networks had been infiltrated by hackers until the FBI gave it notice six weeks after the breach started. Plaintiffs allege 21st Century Oncology’s delay in detecting the breach and notifying patients has subjected to them to well-known risks and harms associated with patient privacy breaches, including medical identity theft.
Plaintiffs’ Complaint was filed in federal court in Ft. Myers, Florida, where 21st Century Oncology maintains its headquarters. Plaintiffs’ case has been assigned to Judge Sheri Polster Chappell, Case No. 16-cv-00223. Plaintiffs allege 21st Century Oncology violated state and federal laws intended to protect patient privacy, including the Fair Credit Reporting Act. Plaintiffs seek to represent patients throughout the United States who have been impacted by this data breach and seek damages and other relief necessary to remedy the harm caused by the breach and ensure their data is protected in the future.
